By accessing and using PortfolioInSite, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These Terms of Service constitute the entire agreement between you and Agility Ops Business Pty Ltd regarding the use of PortfolioInSite.
PortfolioInSite is a Jira Cloud application designed to provide unified portfolio management and visualization capabilities. Our service integrates with your Jira Cloud instance to help you manage, track, and visualize your project portfolios across multiple teams and initiatives.
When you create a PortfolioInSite account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to refuse service or delete accounts that violate these Terms of Service or engage in abusive behavior.
You agree not to use PortfolioInSite for any illegal or unauthorized purpose. You specifically agree not to:
PortfolioInSite and all content, features, and functionality are owned by Agility Ops Business Pty Ltd, its licensors, or other providers of such material. All right, title, and interest in and to our service and content are the exclusive property of Agility Ops Business Pty Ltd.
You are granted a limited, non-exclusive, non-transferable license to use PortfolioInSite for your own internal business purposes. This license is subject to these Terms of Service and does not permit:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AGILITY OPS BUSINESS PTY LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE TOTAL LIABILITY OF AGILITY OPS BUSINESS PTY LTD FOR ANY CLAIM ARISING FROM OR RELATING TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Agility Ops Business Pty Ltd, its directors, employees, and agents from any and all claims, damages, losses, and expenses (including attorney's fees) arising from or related to:
Agility Ops Business Pty Ltd reserves the right to terminate or suspend your account and access to PortfolioInSite immediately, without notice or liability, if you violate these Terms of Service or engage in conduct we determine is harmful or illegal.
You may terminate your account at any time by contacting our support team. Upon termination, your right to use PortfolioInSite ceases immediately, and all data associated with your account will be deleted within 30 days.
PORTOFLIOINSITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
These Terms of Service are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Australia for the resolution of any disputes arising from these Terms of Service or your use of PortfolioInSite.
We may update these Terms of Service from time to time. We will notify you of material changes by posting the revised terms on our website and updating the "Effective Date" at the top of this page. Your continued use of PortfolioInSite following the posting of revised Terms of Service means that you accept and agree to the changes. It is your responsibility to review these Terms of Service periodically for updates.
